Chapter 6 - The Architecture of Liability

A licensed attorney in the State of Illinois does not flinch at the mention of the Attorney Registration and Disciplinary Commission.
We fear the ARDC when we have commingled client funds, failed to disclose conflicts of interest, or lied to a tribunal. We do not fear it when an unlicensed twenty-nine-year-old brand strategist drafts a settlement demand on the notes app of his iPhone and threatens regulatory retaliation unless we surrender private real estate to his criminal enterprise.
In the legal profession, that is not called aggressive negotiation.
It is called extortion under 720 ILCS 5/12-6, which classifies the communication of a threat to expose an individual to regulatory disgrace or criminal accusation, with the intent to obtain property or services, as a Class 4 felony.
I sat at the pine table in my lake house, the soft hum of the refrigerator the only sound in the midnight quiet. I opened my firm’s secure portal, pulled up our formal legal letterhead, and began to assemble the response.
I did not write with fury. Fury produces adjectives, and adjectives are useless in litigation. I wrote with the cold, rhythmic precision of a commercial litigator cataloging a catastrophic contractual breach.
*VIA ELECTRONIC TRANSMISSION ONLY*
*DATE: June 14*
*TO: Nolan Price; Sabine Kellan*
*RE: Formal Notice of Criminal Referral, Civil Preservation, and Response to Extortionate Demand*
*Mr. Price,*
*Your correspondence dated June 13, transmitting an ultimatum demanding (1) the transfer of $11,400 in personal funds, (2) unauthorized commercial access to real property located at 412 Blackwood Lane, and (3) an agreement to forgo criminal complaints under threat of an ethics grievance filed with the Illinois ARDC, has been preserved as evidence.*
*Please be advised of the following facts:*
*1. Real Property Ownership: The parcel identified as 412 Blackwood Lane is held in fee simple exclusively by Meredith A. Kellan under a recorded warranty deed with the Walworth County Register of Deeds. Neither Sabine Kellan nor 'Kellan-Price Media LLC' holds any legal, equitable, or possessory interest in this property. Any oral representations made by Marjorie Kellan regarding 'family stewardship' are legally void under the Wisconsin Statute of Frauds (Wis. Stat. § 706.02), which bars unwritten conveyances or encumbrances of real property.*
*2. Criminal Exposure: At approximately 8:45 PM this evening, deputies from the Walworth County Sheriff’s Department conducted an on-site investigation at 412 Blackwood Lane (Incident Report #24-0891). Said investigation documented unauthorized entry, the execution of a fraudulent commercial lease bearing a forged signature in my name, and the unlawful collection of $5,000 from Gregory Finch via electronic wire. This conduct constitutes Felony Identity Theft under Wis. Stat. § 943.201 and Forgery under Wis. Stat. § 943.38.*
*3. Extortion and Regulatory Misconduct: Under Illinois law, conditioning the withholding of an administrative or disciplinary complaint upon the receipt of cash and real estate concessions constitutes criminal intimidation and extortion. Furthermore, your written admission that the proceeds of these unauthorized rentals were 'earmarked for Kellan-Price Media LLC' directly implicates you as a co-conspirator and beneficiary in the underlying wire fraud.*
*4. Immediate Demands:*
*a. You and Sabine Kellan shall immediately cease and desist all advertising, marketing, and leasing of 412 Blackwood Lane.*
*b. You shall immediately transmit the names, contact information, and payment ledgers for the three prospective bookings scheduled for the summer season, so that formal cancellation notices may be issued before additional defrauded parties arrive on my property.*
*c. You shall preserve all electronic communications, bank records, platform dashboards, and messaging histories pursuant to an immediate litigation hold.*
*If the administrative login credentials and customer records for the fraudulent listing are not delivered to my inbox by 8:00 AM Central Standard Time on Saturday, June 14, I will execute a supplemental criminal affidavit naming Nolan Price as an active participant in identity theft and wire fraud, and I will forward your correspondence directly to the Cook County State's Attorney and the Illinois ARDC as prima facie evidence of attempted extortion.*
*Govern yourselves accordingly.*
*Meredith A. Kellan, Esq.*
I read it through once. I attached a scanned PDF copy of Deputy Vance’s incident report, Gregory Finch’s signed statement, and the fraudulent lease featuring my forged signature in looped, childlike cursive.
I hit send.
Next, I opened a new browser tab. I located the customer support portal for the boutique short-term rental platform Sabine had used to advertise my home. I navigated to the intellectual property and fraud intake division.
I uploaded the county deed, my driver's license, the active listing URL, and the police incident number. I marked the submission *URGENT: Active Criminal Investigation / Unauthorized Property Listing / Unlawful Detainer*.
Then, I looked at the three upcoming booking dates Finch’s contract had inadvertently revealed through the platform’s shared calendar: June 20, July 4, and July 18.
Sabine hadn't just dipped her toes into minor fraud. She had sold prime holiday weekends on a lakefront property she didn't own, pocketing tens of thousands of dollars while leaving me with the structural, financial, and legal liability.
My phone screen remained dark.
I stood up, walked to the deadbolt on the front door, turned it, and checked the secondary latch I had installed myself three years ago.
Outside, the lake was as black as glass. For thirty-four years, my family had mistaken my patience for weakness. They had assumed that because I was willing to bleed for their comfort, I would never notice the knife in their hands.

They were about to learn that when a contracts attorney decides to enforce the terms, there are no family discounts.
